Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and realtygodra Studio ("Company," "we," "us," or "our"), governing your use of our website realtygodra.lol and our web development services.

By accessing our website or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our website or services.

Project Process

Initial Consultation

All projects begin with an initial consultation where we discuss your requirements, goals, and expectations. This consultation is provided free of charge and helps us understand your needs before providing a detailed proposal.

Project Proposal

Following the consultation, we will provide a written proposal outlining the project scope, deliverables, timeline, and pricing. This proposal remains valid for 30 days from the date of issue unless otherwise stated.

Project Acceptance

Upon your acceptance of the proposal and receipt of the initial deposit, we will commence work on your project according to the agreed timeline. Acceptance may be indicated through a signed agreement, written email confirmation, or payment of the initial deposit.

Project Milestones

Projects are typically divided into milestones, with review periods between each phase. You will have the opportunity to provide feedback at each milestone, and we will incorporate reasonable revisions as outlined in the project scope.

Payment Terms

Pricing

All prices quoted are in Czech Koruna (CZK) or Euro (EUR) as specified in the proposal. Prices do not include VAT unless explicitly stated. Additional services or features requested after project commencement may incur additional charges.

Payment Methods

We accept payments via bank transfer, credit card, and other methods as agreed upon. Payment details will be provided on your invoice.

Late Payments

Invoices are due within 14 days of issue unless otherwise specified. Late payments may result in work being paused until payment is received. We reserve the right to charge interest on overdue amounts at a rate of 1.5% per month.

Client Responsibilities

To ensure successful project completion, you agree to:

Intellectual Property

Ownership Transfer

Upon receipt of full payment, ownership of the custom design elements and code created specifically for your project will transfer to you. This includes custom graphics, website layouts, and bespoke functionality developed for your website.

Third-Party Components

Some projects may incorporate third-party components, libraries, or templates that are subject to their own licensing terms. We will inform you of any such components and their respective licenses.

Portfolio Rights

We reserve the right to display completed work in our portfolio, case studies, and marketing materials, unless you request otherwise in writing.

Pre-Payment Rights

Until full payment is received, we retain all intellectual property rights in the work produced. No work may be used, published, or deployed until final payment is made.

Revisions and Changes

Included Revisions

Each project includes a specified number of revision rounds as outlined in your project proposal. Revisions must be requested within the agreed review periods.

Additional Revisions

Additional revision requests beyond the included allowance will be quoted and billed separately. Significant scope changes may require a new proposal.

Change Requests

Changes to the project scope after work has commenced may affect the timeline and cost. All change requests should be submitted in writing, and we will provide an assessment of the impact before proceeding.

Project Termination

Termination by Client

You may terminate the project at any time by providing written notice. In such cases, you will be responsible for payment of all work completed up to the termination date, plus any third-party costs incurred.

Termination by Company

We reserve the right to terminate a project if payments are significantly overdue, if you fail to provide required materials after reasonable requests, or if continuation of the project would require us to violate any laws or ethical standards.

Refunds

Initial deposits are non-refundable as they cover project setup, planning, and initial work. Partial refunds for other payments may be considered on a case-by-case basis based on work completed.

Warranty and Support

Bug Fixes

We provide a 30-day warranty period after project launch during which we will fix any bugs or errors in the code we developed at no additional charge. This warranty does not cover issues caused by third-party modifications, hosting problems, or changes to third-party services.

Ongoing Support

Ongoing maintenance and support beyond the warranty period is available through separate support agreements. Details of our support packages can be provided upon request.

Limitation of Liability

To the maximum extent permitted by law, realtygodra Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses, resulting from:

Our total liability for any claims arising from these Terms or our services shall not exceed the total amount you paid to us in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless realtygodra Studio, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney fees) arising from your use of our services, your violation of these Terms, or your violation of any rights of a third party.

Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project. This includes but is not limited to business strategies, technical specifications, and customer data. This obligation survives the termination of any agreement between us.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic. Any disputes arising from these Terms or our services shall be resolved in the courts of Prague, Czech Republic.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes indicates your acceptance of the modified Terms. For ongoing projects, the Terms in effect at the time of project acceptance will apply unless otherwise agreed.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
